EU citizens and their family members

An EU citizen is someone who holds citizenship of one of the 27 European Union states. Citizens of Iceland, Liechtenstein, Norway and Switzerland also have similar rights. Citizens of the United Kingdom of Great Britain and Northern Ireland are considered EU citizens if they were legally resident in the Czech Republic on 31 December 2020.

A family member of an EU citizen is:

1. a spouse, (registered) partner
2. a foreigner who has a permanent partnership relationship, which is not marriage, with an EU citizen and lives with them in a common household (partner/partner)
3. a child under the age of 21 or such a child of the spouse of an EU citizen
4. a parent, if it is an EU citizen under 21 years of age, for whom he/she is actually taking care
5. a descendant or ancestor or a descendant or ancestor of the spouse of an EU citizen, if he or she is dependent on maintenance or other necessary care provided by an EU citizen or his or her spouse for the purpose of meeting his or her basic needs, or was dependent on such maintenance or other necessary care immediately before entering the territory of the state of which he or she is a citizen or of the state in which he or she was authorised to reside
6. a foreigner who is a family member of an EU citizen and lived in the same household with the EU citizen in the state of which he is a citizen or in the state in which he had a residence permit before entering the territory
7. a foreigner who is a relative of an EU citizen and is dependent on maintenance or other necessary care provided by an EU citizen for the purpose of satisfying his or her basic needs, or was dependent on such maintenance or other necessary care immediately before entering the territory of the state of which he or she is a citizen or of the state in which he or she was permitted to reside
8. a foreigner who is a relative of an EU citizen and is unable to take care of themselves for serious health reasons without the personal care of an EU citizen
